Terms of Use

1. Agreeing to these terms

These Terms of Use are an agreement between you and Fanapult ("Fanapult", "we", "us") about your use of the Fanapult app, the fanapult.com website and anything else we offer that links to these terms (together, "Fanapult"). By creating an account or using Fanapult, you agree to these terms and to our Privacy Policy. If you don't agree, please don't use Fanapult.

2. Who can use Fanapult

To use Fanapult you must:

• be at least 18 years old, and at least the legal age to bet on sports where you live, if that age is higher;
• be in the United States;
• be able to agree to these terms; and
• not have been removed from Fanapult before, unless we've told you in writing that you may come back.

You're responsible for following the laws where you live, including any laws about sports betting. Fanapult doesn't decide whether any bet you place elsewhere is legal.

3. Fanapult is not a sportsbook

Fanapult helps you follow and share bets you've already placed somewhere else. Fanapult does not:

• accept, place, broker or settle bets;
• hold, move or pay out money, or offer prizes for picks;
• connect to or log in to any sportsbook account;
• show odds for betting or recommend what to bet; or
• sell picks or let members sell them.

Nothing in Fanapult is betting, financial or legal advice. A member's record or a slip on Fanapult is not a tip, and you shouldn't treat it as one. Any bet you place is your own decision, made with a sportsbook you choose, under that sportsbook's rules.

4. Grades, live numbers and sports data

Fanapult shows live game numbers and grades picks from public game information, such as each game's box score. We work hard to get these right, but they can be late, incomplete or wrong. For example, a stat can be corrected after a game, a game can be postponed, or a slip can be read or entered incorrectly.

• Your sportsbook's settlement is final. If Fanapult's grade differs from how your sportsbook settled your bet, your sportsbook is right for your money. Fanapult's grade only affects what Fanapult shows.
• We may regrade a pick when the game information changes, and we may correct or remove grades that were made in error.
• Records, hit rates and trophies are for fun and bragging rights. They have no cash value.

5. Your account

• You sign in with Apple, Google or email. Keep your sign-in secure, and tell us right away at support@fanapult.com if you think someone else has used your account.
• The information you give us, like your username, must be accurate and must not pretend to be someone else.
• One person, one account. Don't sell, share or transfer your account.
• You're responsible for what happens under your account.
• We may reclaim a username that impersonates someone, is misleading or breaks the community rules.

6. Your content

"Your content" means what you add to Fanapult: slips and picks, screenshots you send to be read, your profile name, username, photo and bio, and anything else you post.

• You own your content. These terms don't change that.
• You give us permission to use it to run Fanapult. You grant Fanapult a worldwide, non-exclusive, royalty-free license to host, store, copy, process, display and share your content, only as needed to operate, improve and promote Fanapult the way the app works and the way you've chosen to share it (for example, showing a My crew slip to your crew, or showing a share link preview). This license ends when your content is deleted, except for copies others already received from you (like a screenshot a friend took) and brief backup copies that expire on their own.
• You're responsible for your content. You confirm you have the right to post it and that it follows these terms and the law.
• We don't have to keep your content, and we may remove it if it breaks these terms.

7. Community rules

Fanapult is for sweating games with friends. We have zero tolerance for content or behavior that makes that worse. Don't post, share or do any of the following:

• harassment, bullying, threats, or encouraging anyone to harm themselves or others;
• hate speech or attacks based on race, ethnicity, national origin, religion, disability, sex, gender identity, sexual orientation, age or similar traits;
• sexual content, graphic violence, or anything involving minors;
• other people's private information, like real names they haven't shared, addresses, phone numbers, or sportsbook account details;
• impersonating a person, team, league, sportsbook or Fanapult;
• selling or advertising picks, tipster services, paid groups, promo codes, referral links, or anything else for money;
• encouraging anyone under 18, or anyone where betting is illegal, to bet;
• spam, scams, fake accounts, or doctored slips meant to mislead people;
• anything illegal, or anything that infringes someone else's rights; or
• trying to break, overload, scrape, reverse engineer or get around the security or limits of Fanapult, or to see data you aren't meant to see.

8. Reporting, blocking and removal

• Block: you can block any member in the app. They won't be able to see your slips or profile, add you to their crew, or send you crew alerts. You can unblock them in Settings and privacy → Blocked members.
• Report: you can report a member or something they posted in the app, or by emailing support@fanapult.com with their username and what happened.
• What we do: we review reports within 24 hours. When something breaks these rules, we remove it, and we may suspend or remove the account that posted it.
• We may also remove content or restrict accounts on our own if we believe it's needed to protect members, Fanapult or others, or to follow the law.

9. The slip reader

When you choose to have Fanapult read a screenshot, the image is sent to Google's Gemini service to find the picks on it. You should only send screenshots that you have the right to share, and we suggest cropping out anything you don't need, like account numbers or balances. The reader can make mistakes, so check your picks before you save them. The Privacy Policy explains how screenshots are handled.

10. Other companies' services and names

Fanapult relies on other companies, including Apple, Google, Supabase and public sports data providers. Their services have their own terms, and we're not responsible for them.

Team, league, player and sportsbook names, logos and images belong to their owners and are used only to identify them. Fanapult isn't affiliated with, sponsored by or endorsed by any sportsbook, league, team or player unless we clearly say so.

11. Responsible play

Fanapult is meant to make games more fun to watch, not to push anyone to bet more. You can mute alerts, keep slips to yourself, or delete your account at any time. 12. Fanapult's app and content

Fanapult, including its software, design, names, logos and the content we create, is owned by Fanapult or our licensors and protected by law. As long as you follow these terms, we give you a personal, limited, non-exclusive, non-transferable, revocable license to use the Fanapult app on Apple devices you own or control, for your own non-commercial use. You may not copy, sell, modify or resell Fanapult or use it to build a competing service.

If you send us ideas or feedback, we may use them without owing you anything.

13. Ending your use

• You can stop using Fanapult at any time. You can delete your account in the app (Settings and privacy → Account → Delete account) or see how to delete your account.
• We may suspend or end your access if you break these terms, if we must by law, or if we stop offering Fanapult. Where it's reasonable, we'll tell you why.
• Sections that by their nature should last after your account ends will continue to apply, including sections 6 (as described there), 12, and 14 through 20.

14. Disclaimers

FANAPULT IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT THE LAW ALLOWS, WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. WE DON'T PROMISE THAT FANAPULT WILL ALWAYS BE AVAILABLE, ERROR-FREE OR SECURE, OR THAT GRADES, LIVE NUMBERS, ALERTS, SCORES OR OTHER SPORTS INFORMATION WILL BE ACCURATE, COMPLETE OR ON TIME. YOU USE FANAPULT AT YOUR OWN RISK, AND ANY BETTING DECISION IS YOURS ALONE.

15. Limits on our liability

TO THE FULLEST EXTENT THE LAW ALLOWS, FANAPULT AND ITS OWNERS, EMPLOYEES AND CONTRACTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOST PROFITS, LOST WAGERS OR WINNINGS, LOST DATA OR LOSS OF GOODWILL, ARISING OUT OF OR RELATED TO FANAPULT OR THESE TERMS, EVEN IF WE WERE TOLD THEY WERE POSSIBLE. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO FANAPULT WILL NOT BE MORE THAN THE GREATER OF FIFTY U.S. DOLLARS ($50) OR THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM. SOME STATES DON'T ALLOW SOME OF THESE LIMITS, SO THEY MAY NOT ALL APPLY TO YOU.

16. Your responsibility for claims

To the extent the law allows, you agree to defend and cover Fanapult against claims, losses and costs (including reasonable legal fees) brought by someone else that come from your content, your breaking these terms, or your breaking the law or someone else's rights.

17. Disputes and governing law

If you have a problem with Fanapult, please email support@fanapult.com first. Most issues can be solved quickly, and we'll try in good faith for at least 30 days before either of us goes further.

These terms are governed by the laws of the State of Ohio and applicable U.S. federal law, without regard to conflict-of-law rules. Any dispute that isn't resolved informally will be handled in the state or federal courts located in Ohio, and you and Fanapult agree to those courts' jurisdiction, except that either of us may bring a qualifying claim in small claims court where you live. Nothing here takes away rights you have under laws that can't be waived.

18. If you got Fanapult from the App Store

If you downloaded the Fanapult app from Apple's App Store, these extra terms apply:

• These terms are between you and Fanapult only, not Apple. Fanapult, not Apple, is responsible for the app and its content.
• Your license to use the app is limited to using it on Apple-branded devices you own or control, as allowed by the Usage Rules in Apple's Media Services Terms and Conditions.
• Apple has no obligation to provide maintenance or support for the app.
• If the app fails to meet any warranty that applies, you can tell Apple, and Apple will refund the price you paid for the app, if any. To the extent the law allows, Apple has no other warranty obligation for the app. Any other claims, losses or costs from a failure to meet a warranty are Fanapult's responsibility, as far as these terms allow.
• Fanapult, not Apple, is responsible for handling any claims you or others have about the app, including product liability claims, claims that the app doesn't meet a legal or regulatory requirement, and claims under consumer protection, privacy or similar laws.
• If someone claims the app or your use of it infringes their intellectual property, Fanapult, not Apple, is responsible for investigating, defending, settling and resolving that claim.
• You confirm that you are not located in a country that is subject to a U.S. Government embargo or that the U.S. Government has designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
• Questions, complaints or claims about the app go to Fanapult at support@fanapult.com.
• Apple and its subsidiaries are third-party beneficiaries of these terms, and once you accept them, Apple has the right to enforce them against you as a third-party beneficiary.

19. Changes to these terms

We may update these terms as Fanapult changes. When we do, we'll update the date at the top. If a change is significant, we'll tell you in the app before it takes effect. If you keep using Fanapult after a change takes effect, you accept the updated terms. If you don't agree, you can stop using Fanapult and delete your account.

20. General terms

• These terms and the Privacy Policy are the whole agreement between you and Fanapult about Fanapult.
• If part of these terms can't be enforced, the rest still applies.
• If we don't enforce a part of these terms right away, we can still enforce it later.
• You can't transfer your rights under these terms without our permission. We may transfer ours, for example if Fanapult is sold or merged, and we'll tell you if that happens.
• Neither of us is responsible for delays caused by things outside our reasonable control.
